CUSTOM PET PORTRAIT TERMS & CONDITIONS

These Terms & Conditions apply to custom pet portraits purchased from Aquila Watercolor. By placing an order, you agree to the terms below.
YOUR CUSTOM PORTRAIT
Each custom portrait features one pet and is individually drawn and painted by hand by Jess using watercolor.
The finished original artwork measures 22 × 28 inches and focuses primarily on your pet’s face, with a small amount of the neck and shoulders.
Because every portrait is handmade, the finished artwork is an artistic interpretation of your reference photo rather than an exact photographic reproduction. Colors, watercolor blooms, paint runs, splatters, textures, and other characteristics will naturally vary from portrait to portrait.
Props, accessories, and complex backgrounds are generally not included. Their inclusion, along with other compositional decisions, is at Jess’s artistic discretion.
REFERENCE PHOTOS
After checkout, you will receive a portrait details form where you can upload one or more reference photos.
Jess paints from one primary reference photo, although you are welcome to submit several so she can choose the image that will translate best into a portrait.
Expression, facial detail, lighting, image quality, and composition can all affect the finished artwork.
If Jess determines that none of the submitted photos are suitable and a workable replacement photo cannot be provided, your order will be canceled and fully refunded.
By submitting a reference photo, you confirm that you own the photograph or otherwise have permission to provide it for the purpose of creating your portrait.
You also give Aquila Watercolor permission to use the reference photo as reasonably necessary to create and document the painting process. This may include the photo being incidentally visible in livestreams, process videos, studio photographs, or other behind-the-scenes content while Jess is creating your portrait.
Separate permission is required for Aquila Watercolor to intentionally feature or prominently display your reference photo in marketing, promotional, before-and-after, or educational content.
SPECIAL REQUESTS
The portrait details form includes space for requests such as color preferences, adding your pet’s name near Jess’s signature, or other personal details.
Jess will consider these requests while retaining artistic discretion over the finished composition, colors, and watercolor techniques.
Because watercolor is a physical, hand-painted medium, some changes may not be possible once paint has been applied to the paper.
PRODUCTION TIME AND SHIPPING ESTIMATES
The current estimated shipping timeframe is displayed on the portrait sales page at the time you place your order.
Production and shipping dates are estimates and are not guaranteed delivery dates.
If you need your portrait by a specific date, please contact Jess before ordering so she can confirm whether the requested timing is possible.
CANCELLATIONS
If you need to cancel your order before Jess has begun work on your portrait, contact Aquila Watercolor as soon as possible. You will receive a full refund.
Once work on your custom portrait has begun, cancellations due to a change of mind are not guaranteed because significant time and materials may already have been committed to creating your artwork.
The Happiness Promise below still applies to the completed portrait before shipment.
APPROVAL AND HAPPINESS PROMISE
When your portrait is finished, Jess will email you a photograph of the completed artwork for review before it ships.
If you would like something adjusted, Jess will work with you when the requested change is reasonably possible within the completed watercolor painting.
If you are still unhappy with the finished portrait and Jess cannot reasonably make the requested adjustment, you may receive a 100% refund before the portrait ships.
Once you approve the completed portrait and it has shipped, the sale is final except in cases of shipping loss or damage described below.
SHIPPING
Shipping within the United States and Canada is $28.
Shipping to select additional countries may be available. If you are outside the United States or Canada, contact Jess before ordering so she can confirm availability and shipping cost.
International customers are responsible for any customs duties, import taxes, or similar charges imposed by the destination country.
Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges caused by an incorrect address or a package returned as undeliverable may be the customer’s responsibility.
LOST OR DAMAGED PORTRAITS
Jess carefully packages each portrait before shipment, and shipping loss or damage is very uncommon.
If your portrait is damaged in transit or confirmed lost by the carrier, contact Aquila Watercolor with photographs, tracking information, or other documentation of the issue.
You will be offered a choice between:
a full-size, high-quality archival print of the finished portrait at no additional cost, or
a full refund, including the original shipping charge.
In some circumstances, Jess and the customer may instead mutually agree to the creation of a replacement original portrait.
Because every watercolor is painted individually by hand, a replacement original will not be an exact duplicate of the first painting.
Aquila Watercolor may request additional documentation or, when applicable, return of damaged artwork before completing a replacement or refund.
FRAMING
Portraits are sold unframed unless otherwise specifically stated.
The finished 22 × 28-inch artwork is a standard frame size and may be displayed in either a ready-made frame or a custom frame.
DIGITAL IMAGE
Your portrait purchase includes a color-corrected digital image of the finished artwork for viewing and sharing online.
This customer-facing image is not the archival, reproduction-quality scan retained by Aquila Watercolor and is not intended to function as a production-ready print file.
You are welcome to share the provided image for your own personal, noncommercial purposes, including on social media.
The provided digital image may not be sold, licensed, used on products for sale, or otherwise used commercially without written permission from Aquila Watercolor.
OWNERSHIP, COPYRIGHT, AND REPRODUCTION RIGHTS
Purchasing a portrait gives you ownership of the physical original artwork.
Copyright and other intellectual property rights in the artwork remain with Aquila Watercolor and the artist.
Aquila Watercolor may photograph, scan, reproduce, display, publish, and otherwise use the commissioned artwork and images or video of the painting process for purposes including:
portfolio and website use
social media
marketing and promotion
educational and instructional materials
prints and other reproductions
shop offerings
future artistic collections or projects
Aquila Watercolor retains the right to create and sell reproductions of the commissioned artwork.
You are welcome to display your original portrait and share photographs or the provided digital image for personal, noncommercial purposes. The artwork may not be independently reproduced, licensed, sold as reproductions, used on products for sale, or otherwise commercially exploited without written permission from Aquila Watercolor.
USE OF CUSTOMER REFERENCE PHOTOS
Aquila Watercolor may use your submitted reference photos as reasonably necessary to create your commissioned artwork and document the painting process.
This may include incidental visibility of a reference photo during livestreams, process videos, studio photographs, or similar behind-the-scenes content.
Aquila Watercolor will not intentionally feature, publish, or prominently display your reference photo in marketing, promotional, before-and-after, or educational materials without your separate permission through the portrait details form.
Granting or declining this additional permission will not affect your portrait order.
Reference photos will not be sold by Aquila Watercolor as standalone images or reproduced for resale.
CHANGES TO THESE TERMS
These Terms & Conditions may be updated from time to time.
The terms in effect at the time your order is placed will apply to that purchase.
Nothing in these Terms & Conditions is intended to limit any rights or protections that cannot legally be waived under applicable law.
